- Screening Phase: During the Screening Phase, Sponsor will screen all uploaded Submissions for adherence to the Guidelines and Restrictions as outlined in Section 5 above. All Submissions that do not meet the Guidelines and Restrictions, in Administrator's sole opinion, will be deemed ineligible for the Voting phase and removed from the photo gallery. All Submissions in adherence to the Guidelines and Restrictions will be deemed finalists ("Finalists") and will be included in the gallery during the Voting phase.
- Voting Phase: During the Voting Phase, the Finalists' Submissions will be posted in an online gallery for public voting at www.powerabrightfuture.com. Legal residents of the fifty (50) United States and the District of Columbia who are at least thirteen (13) years of age or older at the time of voting (“Voter” or “Voters”), will be invited to cast their vote for the Submission which features the School or School program they feel is most deserving of a grant (“Vote” or “Votes”). There are two (2) ways to cast a Vote as described below:
- Online: You may cast a vote online by following the links and instructions at www.powerabrightfuture.com.
- By Text: You can cast a vote by texting the keyword assigned to each Submission to 44144. The keyword associated with each Submission will be available where the Submission is posted in the online gallery for public voting at www.powerabrightfuture.com. Message and Data rates may apply. Text-messaging is supported by the following carriers: Alltel, AT&T, Boost, Nextel, Sprint,T-Mobile, Verizon Wireless and US Cellular. Regional carriers include ACS Wireless, Appalachian Wireless, Bluegrass Cellular, Cellcom, Centennial Wireless, Cincinnati Bell, GCI Communications, Illinois Valley Cellular, Immix Wireless, Inland Cellular, Nex-Tech Wireless, nTelos Wireless, Revol Wireless, Thumb Cellular, Unicel, United Wireless and West Central Wireless.
Subject to the Finalists' compliance with these Official Rules, the School featured in the Submission that receives the highest number of valid votes during the Voting Phase will be deemed the potential Grand Prize winning School. The Schools featured in the Submissions that receive the highest number of valid votes in each of the three categories, Explore, Play, and Create, during the Voting Phase will be deemed the potential First Prize winners. Potential Contest winners will be notified by mail, email or phone on or around January 9, 2012. In the event of a tie, a panel of qualified judges will determine the winning School based on an application of the judging criteria listed below. Sponsor also reserves the right, in its sole discretion, to select an alternate Grand Prize or First Prize winner should the voting appear to have been tampered with or manipulated in any way.
Limits on Voting: Each Voter may Vote one (1) time online and one (1) time via Text as described above, per day during the Voting Phase. Once a day's Vote is cast, subsequent Votes received on the same day from the same person, email address, text-messaging capable device, or user account will be void. All Votes cast must correspond to a single person with a single email address, text-messaging capable device, and/or user account. Each Voter must personally cast his/her Vote and may not solicit and may not delegate by proxy, or otherwise authorize or entice, another person to cast Votes on his/her behalf or that of another person, whether or not using the Voter's name, email address, or user account. Individual Voters may not use multiple email addresses, text-messaging capable devices, and/or user accounts to cast multiple Votes and multiple Voters may not share the same email address.
Prohibitions on Voting: Any discovered attempt by a entrant, Finalist, or Voter to submit, entice, solicit, authorize, or otherwise receive by fraudulent or inappropriate means, including, without limitation, offering prizes or other inducements, more than one (1) Vote per person, per method, per day, or to use fraudulent or multiple email addresses, text-messaging capable devices or identities, or to request or grant request of authorization to Vote by proxy, or to generate Votes by script, macro or other automated means, or any other attempt to impair the integrity of this Contest, or to subvert or circumvent the Voting or Entry processes or these Official Rules may, in Sponsor or Administrator's sole and absolute discretion, result in voiding of all the Voter's or Finalist's Votes and disqualification of the Voter and/or Finalist and corresponding Submission(s) from further participation in the Contest and/or the adjustment, or resetting of a Finalist's cumulative Vote count to zero (“0”). Eligible Votes cast and received will be recorded in Finalists' cumulative Vote totals. While Sponsor and/or Administrator, in their sole discretion, may take action against fraudulent activities they observe or are alerted to, Sponsor and/or Administrator assumes no responsibility or obligation to proactively police participants' activities, or to investigate any and all claims of fraudulent activity. Sponsor and Administrator are not obligated to enter into any correspondence with Entrants, Voters or Finalists regarding a Vote or participants' questionable Voting practices, and no prizes will be awarded to Voters for Votes cast in this Contest.
- Judging: After the conclusion of the Voting Phase, a panel of qualified judges determined by Sponsor (collectively, the “Judges”) in its sole discretion will select from among the remaining Finalists (who were not voted potential Grand Prize or First Prize winners) the potential Judge's Choice Prize winning Submission and corresponding School based on highest scores in the following weighted criteria (“Judging Criteria”):
- Quality of Submission (33%);
- Impact of Program on Children (33%); and
- Fit to Contest Theme of Helping Children (34%).
In the event of a tie, the entrant whose Submission received the highest score in the Fit to Contest Theme of Helping Children category, as determined by the Judges, in its sole discretion, will be deemed the potential Judge's Choice Prize winning School.
- Winner Requirements: A representative with the power to make legally binding decisions on behalf of the School nominated in the potential winning Submissions will be required to sign and return to Sponsor, within ten (10) days of the date notice or attempted notice is sent, a Declaration of Compliance, Liability and Publicity Release ("Declaration") and/or any additional documentation or paperwork required by Sponsor or Administrator in order to claim the applicable prize. If any potential winning School cannot be contacted, fails to execute and return the Declaration within the required time period (if applicable), or prize is returned as undeliverable, potential winning School forfeits the prize. If a potential Grand or First Prize winning School is disqualified for any reason, the School featured in the Submission with the next highest number of votes will be chosen as an alternate winner. If the potential Judge's Choice Prize winning School is disqualified for any reason, the School featured in the Submission with the next highest score as determined by Judge will be chose as an alternate winner. Up to three (3) alternate winning Schools may be determined for any prize, after which the applicable prize may remain un-awarded. Prizes will be fulfilled approximately 8-10 weeks after the conclusion of the Contest.
- Winners' and Schools' Publicity Release and Assignment of Winning Submission: Acceptance of any prize shall constitute and signify both the entrant's and winning School's agreement and consent that Sponsor and its designees may use both the entrant's and winning School's name, city, state, likeness, photo, Submission and/or prize information in connection with the Contest for promotional, advertising or other purposes, worldwide, in any and all media now known or hereafter devised, including the Internet, without limitation and without further payment, notification, permission or other consideration, except where prohibited by law.
