  4. How to Nominate a School: During the Nomination Period, you (“Nominator”) must visit www.powerabrightfuture.com (the “Website”), and complete and submit the registration form. Once you have submitted the registration form, you may nominate a School in either the Explore, Play or Create category (as further described on the Website) by following the directions to upload one (1) photo representing the School and provide answers to the following three questions:

By uploading your Nomination, you agree that it conforms to the Nomination Guidelines, Nomination Terms, and Nomination Content Restrictions, as defined below (collectively, the “Guidelines, Terms, and Restrictions”) and that Sponsor, in its sole discretion, may remove your Nomination and disqualify you from the Promotion if it believes that your Nomination fails to conform to the Guidelines, Terms, and Restrictions.

Limit: Ten (10) Nominations per Nominator, per email address, during the Nomination Period.

In the event of a dispute over who submitted a Nomination, the authorized subscriber of the e-mail account provided in connection with the Nomination, as of the actual time of Nomination, will be deemed to be the Nominator. The “authorized account subscriber” is defined as the natural person who is assigned an e-mail address by an Internet access provider, online service provider or other organization (e.g. business, education, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. If the School nominated by a Nominator is selected as a winning School, then the Nominator may be required to show proof of being the authorized account holder.

Any attempt by any Nominator to upload more than the stated number of Nominations by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that Nominator's Nominations and that Nominator may be disqualified, at Sponsor’s sole discretion. Use of any automated system to participate is prohibited and will result in disqualification. Nominators must have permission from all individuals that appear in a Nomination (if any) to use their name and likeness in the Nomination and to grant the rights set forth herein. If requested, Nominator must be able to provide such permissions in a form acceptable to Sponsor. Neither Administrator nor Sponsor shall be responsible for lost, late, stolen, damaged, incomplete, invalid, un-intelligible, garbled, delayed or misdirected Nominations, which will be disqualified.

  5. Winner Selection: Once the Nomination Period has come to an end, the Winner Selection process will begin. The Winner Selection process, comprised of three phases, is illustrated in the chart and described in sections 5(a) – 5(c) below.
    Phase Timeline
    Screening October 17 - October 22, 2012
    Voting November 12 - December 19, 2012
    Judging December 21, 2012

Note: Sponsor's computer is the official time-keeping device for the Promotion.

    1. Screening Phase: During the Screening Phase, Sponsor will screen all uploaded Nominations for adherence to the Guidelines and Restrictions as outlined above. All Submissions in adherence to the Guidelines and Restrictions will be deemed finalists ("Finalists") for purposes of this Promotion and will be included in the photo gallery on the Website (the “Photo Gallery”) during the Voting phase. Any Nominations that do not conform to the Guidelines and Restrictions, at the discretion of Sponsor, will be deemed ineligible for the Voting Phase (described below) and will be removed from the photo gallery.
    2. Voting Phase: During the Voting Phase, legal residents of the fifty (50) United States and the District of Columbia who are at least thirteen (13) years of age at the time of voting (each a “Voter”), will be able to vote for the Nomination they believe is most deserving of a grant.

Limits on Voting: Each Voter will be able to vote one (1) time through the Website and one (1) time via text as described below, per day during the Voting Phase. Votes received from any Voter in excess of the stated number will be void. All votes cast must correspond to a single person with a single email address, text-messaging capable device, and/or user account. Each Voter must personally cast his/her vote and may not solicit and may not delegate by proxy, or otherwise authorize or entice, another person to cast votes on his/her behalf or that of another person, whether or not using the Voter’s name, email address, or user account. Individual Voters may not use multiple email addresses, text-messaging capable devices, and/or user accounts to cast multiple votes and multiple Voters may not share the same email address or text-messaging capable device.

Prohibitions on Voting: Any discovered attempt by a Nominator, Finalist, or Voter to submit, entice, solicit, authorize, or otherwise receive by fraudulent or inappropriate means, including, without limitation, offering prizes or other inducements, more than one (1) vote per person, per method, per day, or to use fraudulent or multiple email addresses, text-messaging capable devices or identities, or to request or grant request of authorization to vote by proxy, or to generate votes by script, macro or other automated means, or any other attempt to impair the integrity of this Promotion, or to subvert or circumvent the voting or nomination processes or these Official Rules may, in Sponsor or Administrator’s sole and absolute discretion, result in voiding of all the Nominator’s, Voter’s or Finalist’s Votes and disqualification of the Nominator, Voter and/or Finalist and corresponding Nomination(s) from further participation in the Promotion and/or the adjustment, or resetting of a Finalist’s cumulative vote count to zero (“0”). Eligible votes cast and received will be recorded in Finalists’ cumulative vote totals. While Sponsor and/or Administrator, in their sole discretion, may take action against fraudulent activities they observe or are alerted to, Sponsor and/or Administrator assumes no responsibility or obligation to proactively police participants’ activities, or to investigate any and all claims of fraudulent activity. Sponsor and Administrator are not obligated to enter into any correspondence with Nominators, Voters or Finalists regarding a vote or participants’ questionable voting practices, and no prizes will be awarded to voters for votes cast in this Contest.

Subject to the Finalists' compliance with these Official Rules, the School featured in the Nomination that receives the highest number of valid votes during the Voting Phase will be deemed the potential Grand Prize winning School (“Grand Prize Winner”). The Schools featured in the Nominations that receive the highest number of valid votes in each of the three categories, Explore, Play, and Create, during the Voting Phase will be deemed the potential Voters’ Choice Winners (each a “Voters’ Choice Winner”). The Grand Prize and Voters’ Choice Winners will be notified by mail, email or phone on or about the dates of December 26-28, 2012. In the event of a tie at the conclusion of the Voting Phase, a panel of qualified judges will determine the winning School based on an application of the judging criteria listed below. Sponsor reserves the right, in its sole discretion, to select an alternate Grand Prize or Voters’ Choice Winner should the voting appear to have been tampered with or manipulated in any way. In such an event, Sponsor will apply the Judging method outlined in section (c) below. Note: Any and all decisions of Sponsor in regards to the Selection of Winners shall be final and binding in all respects.

Those eligible to vote (as described above) can choose from two methods of voting:

      1. You may visit the Website’s Photo Gallery and follow the on-screen instructions.
      2. You may text a particular School’s keyword to 95248. Each School will have a keyword that can be found on the Website.
All votes, regardless of method, must be received by December 19, 2012, at 11:59:59 PM ET.

Voters who use text-messaging to vote will be charged according to their carriers' standard messaging and data rates and Voters should contact their carriers for pricing details. Check your owners' manual for specific text-messaging instructions. Text messaging may not be available through all wireless carriers. Standard text messaging rates and Internet data rates may apply and Sponsor is not responsible for any fees incurred by a Voter. Text message not available in all areas or on all carriers.

Sponsor is not responsible for telephone or Internet service outages, delays, equipment malfunctions and any other technological difficulties that may prevent an individual from sending or receiving a text message. Consult your cellular telephone carrier for complete details.
    3. Judging: After the conclusion of the Voting Phase, a panel of qualified judges determined by Sponsor in its sole discretion (“Judging Panel” or “Judges”) will select the potential Judge's Pick Prize winning Schools (each a “Judge’s Pick”) with the highest-scoring Nomination from among the remaining Finalists' Nominations based on the following three (3) criteria (“Judging Criteria”):

      1. Quality of Submission (33%);
      2. Impact of Program on Children (33%); and
      3. Adherence to Contest Theme of Helping Children (34%).
